General terms and conditions
1. OFFERS
Our offers, including price and delivery, are always subject to change and non-binding, unless otherwise agreed in writing.
2. ORDERS
All orders placed with us shall only become binding on us once they have been confirmed by us in writing. Our terms of delivery and payment shall apply to the execution of the orders.
3. PRICES AND PAYMENT
The prices stated in our order confirmations are subject to change and will be invoiced at the list prices valid on the day of delivery. Payment shall be made either in advance or in cash on collection. If you choose payment in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.
4. DELIVERY
Delivery is ex warehouse Muttenz or the responsible distribution centre. Packaging will not be taken back. Delivery is only made within Switzerland by Planzer. The delivery time is approx. 2-5 working days. We will indicate any deviating delivery times in the order confirmation.
5. SHIPPING
Shipment is carried out at our best discretion by Planzer or forwarding agent at the expense of the recipient. Even if carriage paid delivery has been agreed, the risk of dispatch shall pass to the customer as soon as the consignment has left the factory or the relevant distribution centre. The prices stated on the product pages are inclusive of statutory VAT and other price components. In addition to the prices stated, we charge a flat rate of CHF 9 per order for packaging and delivery within Switzerland. The shipping costs will be clearly communicated to you again on the product pages, in the shopping basket system and on the order page. Further taxes or costs do not apply.
6. DELIVERY DATES ARE NON-BINDING
They will be adhered to as far as possible. The delivery period shall commence on the day on which the final details for the execution of the order come into our possession. In all cases of force majeure, such as shortage of raw materials or operational disruptions at our company or at a supplier, in the event of the occurrence and continuation of unusual events, we shall be entitled to postpone the delivery in whole or in part until the disruption has been remedied or to cancel the order. Once the hindrance has ceased, we shall be entitled to demand acceptance. The buyer shall not be entitled to any claims for damages due to delayed delivery, cancellation of the order or subsequent delivery.
7. RESERVATION OF OWNERSHIP
The delivered goods remain our property until full payment has been made. In the event of resale of the goods still belonging to us, the purchaser shall assign to us the claims accruing to him therefrom.
8. RETURN OF GOODS
Goods ordered and correctly delivered will only be taken back after prior agreement at a reduced amount compared to the invoice and only if the goods are unused and as good as new. The return shall be at the expense of the sender.
9. SCOPE OF APPLICATION
These general terms and conditions apply to all orders placed by customers via the Genesit GmbH online shop. Domestic customers may only export the delivered goods with our express written consent. For deliveries abroad, our special conditions agreed in writing in each case apply, in addition to the above delivery and payment conditions.
10. PLACE OF PERFORMANCE
The place of performance for delivery and payment is Muttenz.
11. PLACE OF JURISDICTION
The exclusive place of jurisdiction for both parties shall be the District Court of Muttenz, irrespective of the amount in dispute.
12. MISCELLANEOUS
The buyer's terms and conditions of purchase are not binding on us, even if they form the basis of the order and we have not objected to them. On the other hand, the placing of an order or the acceptance of the delivered goods shall be tantamount to the acceptance of our terms and conditions of delivery and payment.
13. BINDING NATURE OF THE CONTRACT
The contract shall remain binding even if individual points of its terms and conditions are legally invalid.
